What rights do I have as a union member in New York?
Union members are protected by state and federal law, including the right to organize, bargain collectively, and be represented during disciplinary proceedings. These rights are enforced by agencies like the NLRB and PERB.
Can my employer retaliate against me for trying to organize a union?
No. It is illegal for employers to discipline, fire, or otherwise retaliate against employees for union activity under the National Labor Relations Act (NLRA).
What qualifies as wage theft?
Wage theft can include unpaid wages, unpaid overtime, minimum wage violations, stolen tips, off-the-clock work, or misclassification as an independent contractor.
How do I know if I’m entitled to overtime pay?
If you’re a non-exempt employee in New York and work more than 40 hours in a week, you’re likely entitled to 1.5x your regular rate. Some workers are exempt depending on job duties and pay structure.
What should I do if I’ve been discriminated against at work?
Discrimination based on race, gender, age, disability, religion, or other protected characteristics can be challenged through the EEOC, NYS Division of Human Rights, or in court. We can guide you through the process.
